Terms and Conditions
The terms applying to sales by EKO ONLINE BUSINESS LLC.
The seller
Every sale is made by EKO ONLINE BUSINESS LLC, a limited liability company formed in the State of New Mexico, United States of America, registration number 0008088013, of 4405 Jager Dr NE, Ste C4-4054, Rio Rancho, NM 87144, United States, reachable at support-contact@ekoonlinebusinessllc.com.
EKO Academy, EKO Industrials, EKO Publishing and EKO Design are brands of EKO ONLINE BUSINESS LLC. They are not separate legal entities and they are not sellers.
Formation of the contract
The contract is formed by active acceptance: an unticked box immediately before the order, with the contractual documents reachable before payment. Where a sale takes place on a third-party platform, that platform's terms govern the relationship to the extent they provide.
Before purchase
Before any purchase you are told: the seller's identity, the product description, the price payable, delivery, the refund policy, the complaints procedure and the privacy policy.
Intellectual property and licence
EKO retains ownership of its products, methods and materials. The customer receives a non-exclusive, non-transferable internal-use licence.
For a product bought by an organisation, the licence covers the named purchasing entity, its employees and its individual contractors acting solely for that entity's internal purposes. It does not cover affiliates, the purchaser's own clients, or third parties.
For a course, the licence covers one household: the purchaser and people ordinarily residing with them, for personal, non-commercial learning. Institutional use — school, class, training centre, employer, association, library, public access — requires a separate licence.
Price and payment
Prices are stated on the commercial destination concerned. Payment is handled by a payment provider; EKO does not retain card details.
Delivery
A digital product is made available immediately after payment.
Digital content and withdrawal
A digital product is delivered immediately and a download cannot be undone. Where applicable law provides for it, your express request for immediate performance and your acknowledgement that you thereby lose your right of withdrawal are obtained before download. Without that consent, the right of withdrawal subsists as applicable law provides.
Refund
The default position is: refund available before download, not after. It applies only to the extent applicable law permits. Non-conformity and other mandatory remedies remain in every case.
Warranties
EKO warrants no outcome. EKO does not warrant that a product or service will produce any given commercial, operational or financial result, that it confers any certification or qualification, or that it places the customer in compliance with any standard or regulation. EKO certifies nothing.
Rights nothing removes
Nothing in these terms excludes or limits a warranty or right that applicable law does not allow to be excluded — including mandatory consumer rights as to conformity, refund, withdrawal, remedies and forum — or liability for fraud or wilful misconduct. This clause prevails over anything to the contrary.
Liability — business customers
Where the customer contracts in the course of a business, and to the extent law permits: implied warranties are disclaimed; EKO is not liable for indirect or consequential loss, including loss of profit, business, data or opportunity; and EKO's aggregate liability in respect of a product is capped at the amount actually paid for that product. These exclusions do not apply to the rights above.
Liability — consumers
The caps applying to business customers do not apply to a consumer. EKO's obligations to a consumer are those applicable law imposes, and they are neither reduced nor restated here.
Services
A service is the subject of a separate agreement. EKO undertakes to perform it with the reasonable skill and care expected of a professional, with no guaranteed outcome. Scope and assumptions are defined in writing and implementation decisions belong to the customer.
Complaints
Complaints are made in writing to support-contact@ekoonlinebusinessllc.com, giving the order reference, what happened and what you are asking for. EKO acknowledges receipt and answers in writing.
EKO imposes no arbitration for consumer purchases. You keep access to the courts and redress mechanisms the law gives you.
Governing law
Contracts with a business customer are governed by the law of the State of New Mexico, United States of America.
For a consumer, New Mexico law applies without prejudice to the mandatory protections and compulsory forums available under the law of their residence. Mandatory Cameroonian rules applicable to EKO's activities in Cameroon remain applicable.
